Terms of Service

1. Acceptance of Terms

By creating an account, subscribing, or otherwise using GIGAnalyser (the "Service"), operated by GIGAnalyser ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of the Service

GIGAnalyser provides AI-powered tools that help freelancers write gig titles, bios, descriptions, tags, outreach messages, and other written content for use on third-party freelance marketplaces. The Service includes:

• GIG Craft AI, AI Gig Covers, BioBuilder, Review Reply AI, GIG Score Engine, OutreachPro, NicheRadar, CompeteX, Buyer Persona, and Rate Advisor;
• A web dashboard that stores your generated content and history;
• Customer support via WhatsApp and email.

3. Accounts & Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. When you create an account you agree to:

• Provide accurate, current, and complete information;
• Maintain the security of your password and account;
• Promptly notify us of any unauthorised use.

You are responsible for all activity that occurs under your account.

4. Payments, Subscriptions & Refunds

Subscriptions are billed in advance on a recurring basis (monthly or as otherwise indicated at checkout). The 7-Day Trial is a one-time fee; at the end of the trial your plan will not auto-renew unless you explicitly upgrade.

• Currency: Prices are shown in USD by default and converted to Nigerian Naira (NGN) at our published rate for Paystack payments.
• Provider: Payments are processed by Paystack. By paying you also agree to Paystack's terms.
• Refunds: If you are not satisfied within the first 7 days of a paid plan, contact us on WhatsApp (+2349155325985) for a full refund. Refunds are not available after 7 days except where required by Nigerian law.
• Cancellation: You can cancel anytime from your dashboard. You keep access until the end of the period you paid for.
• Taxes: Prices are exclusive of any applicable taxes, which Paystack will calculate at checkout where required.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, fraudulent, or misleading;
• Impersonate any person or entity, or misrepresent your affiliation;
• Spam third-party platforms or violate their Terms of Service;
• Attempt to reverse-engineer, resell, or scrape the Service;
• Circumvent rate limits or use the Service in any way that could damage, disable, or impair it.

We may suspend or terminate your account if we reasonably believe you are violating this section.

6. AI-Generated Content

The Service uses large language models and generative AI. You acknowledge that:

• Outputs are generated automatically and may contain inaccuracies;
• You are responsible for reviewing, editing, and approving any content before publishing it to a third-party platform;
• We do not guarantee specific business outcomes (orders, rankings, income) from using the Service;
• You retain ownership of the content you generate. We claim no ownership over your outputs.

7. Intellectual Property

The Service, including its design, code, branding, and AI prompts, is owned by GIGAnalyser and protected by intellectual-property laws. You may not copy, modify, distribute, or create derivative works of the Service without our written permission. Feedback you send us may be used by us without restriction.

8. Third-Party Platforms (Fiverr, Upwork, Toptal, Freelancer)

The Service is independent and not affiliated with, endorsed by, or sponsored by Fiverr, Upwork, Toptal, Freelancer, or any other third-party marketplace. You are solely responsible for complying with their terms when publishing AI-generated content on their platforms.

9. Termination

You may terminate your account at any time from the dashboard. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or use the Service in a way that may create legal exposure for us. Upon termination, your right to use the Service ends immediately.

10. Disclaimer & Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, GIGAnalyser shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the latest revision. Material changes will be announced by email or in-product notification. Continued use after a change means you accept the new Terms.
